By accessing, browsing, or using the FitNova Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will notify you of material changes via email or in-app notification.

To use FitNova, you must:

• Be at least 16 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the Platform under any applicable law
• Provide accurate, current, and complete registration information

If you are using the Platform on behalf of an organization (e.g., a gym or fitness studio), you represent and warrant that you have the authority to bind that organization to these Terms.

When you create an account, you agree to:

• Provide truthful, accurate, and complete information during registration
• Maintain and promptly update your account information as needed
• Keep your password secure and confidential — do not share it with others
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent purposes.

Subscription Plans

FitNova offers various subscription plans, including free and premium tiers. Details of each plan, including features and pricing, are available on our pricing page. Prices are subject to change with reasonable advance notice.

Billing & Renewals

• Paid subscriptions are billed in advance on a recurring basis (monthly or annually)
• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method on file for recurring fees
• All prices are displayed in USD unless otherwise indicated

Refunds & Cancellations

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• Refunds are provided in accordance with applicable consumer protection laws
• Promotional or trial periods may be subject to additional terms

You agree to use the Platform in accordance with all applicable laws and these Terms. You may:

• Access and use the Platform for personal, non-commercial fitness purposes
• Book and attend fitness classes, sessions, and events listed on the Platform
• Interact with trainers, instructors, and other members respectfully
• Share feedback, reviews, and content in community areas in good faith
• Connect third-party fitness devices and apps as supported

You agree not to:

• Use the Platform for any unlawful, fraudulent, or malicious purpose
• Impersonate another person or misrepresent your affiliation with any entity
• Upload or transmit viruses, malware, or any harmful code
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Scrape, crawl, or use automated means to access the Platform without permission
• Harass, abuse, threaten, or intimidate other users or staff
• Post content that is defamatory, obscene, hateful, or violates any third-party rights
• Circumvent or disable any security features or access controls
• Use the Platform to send unsolicited advertisements or spam
• Resell, sublicense, or commercially exploit any part of the Platform without authorization

Violation of these rules may result in immediate account suspension or termination, and we may pursue legal action where appropriate.

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, software, and design — are owned by or licensed to FitNova and are protected by intellectual property laws.

• You may not copy, modify, distribute, or create derivative works from our content
• The FitNova name, logo, and all related trademarks are our exclusive property
• Limited, revocable, non-exclusive license is granted for personal use of the Platform
• Any unauthorized use terminates the license granted under these Terms

You may submit content to the Platform, including reviews, comments, photos, and fitness data ("User Content"). By submitting User Content, you:

• Retain ownership of your User Content
• Grant FitNova a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform
• Represent that your content does not infringe any third-party rights
• Acknowledge that we may remove content that violates these Terms

We do not endorse or guarantee the accuracy of any User Content. You are solely responsible for the content you submit.

Health & Fitness Disclaimer

FitNova provides fitness-related information and services for general wellness purposes only. Our Platform does not provide medical advice. Always consult a qualified healthcare professional before starting any exercise program, especially if you have pre-existing medical conditions.

Platform Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

• FitNova shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for injuries resulting from exercises or programs accessed through the Platform
• We do not guarantee uninterrupted, error-free, or secure access to the Platform

Either party may terminate this agreement at any time:

• You may delete your account at any time through your account settings or by contacting support
• We may suspend or terminate your access if you violate these Terms or for any other lawful reason
• Upon termination, your right to use the Platform ceases immediately
• Provisions that by their nature should survive termination will remain in effect (e.g., intellectual property, limitation of liability, dispute resolution)

We will make commercially reasonable efforts to allow you to export your data before account deletion, subject to applicable legal requirements.

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to conflict of law provisions.

• Any disputes shall first be resolved through good-faith negotiation between the parties
• If negotiation fails, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association (AAA)
• Arbitration shall take place in Dhaka, Bangladesh, unless otherwise agreed
• Class action lawsuits and class-wide arbitrations are not permitted under these Terms
• You retain the right to bring claims in small claims court if eligible

We reserve the right to modify or replace these Terms at any time. When we make material changes:

• We will update the "Last Updated" date at the top of this page
• We will notify you via email or prominent notice on the Platform at least 30 days before changes take effect
• Your continued use after changes become effective constitutes acceptance
• If you disagree with the revised Terms, you must stop using the Platform and delete your account
